September 30, 2026, is a date many in the EB-5 world are dreading; that’s the grandfathering cutoff, after which EB-5 investments aren’t guaranteed to be adjudicated under the RIA. While efforts to extend this deadline and reauthorize the program beyond 2027 continue, there is concern the momentum built over the last few years will grind to a halt after this date.
